Tina and Philip Sherman suing McDonald's over nude photos

Tina Sherman and her (probably soon to be ex-) husband, Philip, are suing McDonald's after some of their employees posted nude photos of Tina online.
The story goes like this: Philip went to an Arkansas McDonald's and left his cell phone behind. The Mickey Dee's employees returned Sherman's cell phone, but they posted the naked pics online first.
Now Tina and Philip Sherman are suing the local McDonald's franchisee for $3 million!! Wowza!
Tina Sherman says she received text messages from her husband’s cell phone while the employee at McDonald's were supposed to be keeping it safe. One of the texts evidently read:
"I have seen your photos, and I like what I see.”
The Shermans are suing for suffering, embarrassment and the cost of having to move to a new home.
