As we previously told you Kevin Federline introduced a "secret witness" Monday in court as he tries to get custody of his kids from Britney Spears.

The secret witness is Tony Barretto, a former Spears bodyguard.  Tony filed a declaration claiming "nudity, drug use and safety issues post-rehab."

Barretto's high profile attorney Gloria Allred said that Tony was willing to testify under oath saying he was "very concerned" about the safety of Britney's two boys.  Instead, both sides chose not to cross examine leading Allred to call Barretto's statement in court "unrefuted and unchallenged."

During the press conference, Allred also said that she has spoken to County Counsel for Child Protective Services about Barretto's concerns.

This is about to get really good!
